General Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Cooling-off period: the period during which the consumer may exercise their right of withdrawal;
- Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur;
- Day: calendar day;
- Continuous transaction: a distance contract concerning a series of products and/or services, for which the delivery and/or acceptance obligations are spread over time;
- Durable data carrier: any means that allows the consumer or entrepreneur to store information personally addressed to them in a manner that allows future consultation and unchanged reproduction;
- Right of withdrawal: the consumer’s right to cancel the distance contract within the cooling-off period;
- Entrepreneur: the natural or legal person offering products and/or services remotely to consumers;
- Distance contract: a contract concluded within a system organized by the entrepreneur for the remote sale of products and/or services, using one or more means of remote communication up to and including the conclusion of the contract;
- Means of remote communication: a method that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present in the same location;
- General Terms and Conditions: these General Terms and Conditions of the entrepreneur.
Article 2 – Applicability
- These general terms and conditions apply to every offer of the entrepreneur and to every distance contract and order between the entrepreneur and the consumer.
- Before the distance contract is concluded, the consumer shall have access to these terms and conditions. If this is not reasonably possible, the entrepreneur shall indicate where the general terms and conditions can be inspected and will provide them free of charge upon request.
- If the distance contract is concluded electronically, the text of these terms and conditions may be provided electronically in a way that allows the consumer to store them easily on a durable data carrier.
- If specific product or service conditions also apply, these provisions apply in addition, and in case of conflicting conditions, the consumer may rely on the provision most favorable to them.
- If one or more provisions are wholly or partially invalid, the remaining provisions remain in effect, and the invalid provision shall be replaced with a provision that closely approximates the original intent.
- Situations not explicitly covered shall be interpreted in the spirit of these terms.
- Ambiguities shall be interpreted according to the spirit of these terms.
Article 3 – The Offer
- If an offer is limited in time or conditional, this will be clearly stated.
- All offers are non-binding and may be changed or adjusted by the entrepreneur.
- Offers contain a complete and accurate description of the products or services, sufficient for the consumer to evaluate the offer.
- Images are a true representation, but minor errors or misprints do not bind the entrepreneur.
- Each offer contains information regarding:
- price (excluding customs and import VAT, which is the consumer’s responsibility);
- any shipping costs;
- how the contract is formed and required actions;
- applicability of the right of withdrawal;
- payment, delivery, and execution methods;
- acceptance periods and price guarantees;
- tariffs for remote communication if different from standard rates;
- archiving of the contract;
- how consumers can check or correct their submitted information;
- other available languages;
- applicable codes of conduct;
- minimum duration for continuous transactions.

Article 4 – The Contract
- The contract is concluded when the consumer accepts the offer and meets its conditions.
- Acceptance via electronic means is confirmed promptly by the entrepreneur.
- The entrepreneur implements appropriate technical and organizational measures for secure electronic data transfer and payment.
- The entrepreneur may refuse orders if the consumer cannot meet payment obligations or for valid reasons.
- The consumer shall receive, along with the product/service, information regarding:
- business address for complaints;
- withdrawal rights;
- warranties and post-sale service;
- details in Article 4, paragraph 3;
- requirements for terminating contracts of more than one year.
- Continuous transactions’ provisions apply only to the first delivery.
- Contracts are subject to product availability.
Article 5 – Right of Withdrawal
- Consumers may cancel products within 30 days without giving reasons, starting the day after receipt.
- Products must be handled carefully and returned in original condition and packaging with all accessories.
- Notification of withdrawal must be made in writing or via email.
- Returned products must be shipped within 30 days, and proof of shipment is required.
Article 6 – Costs of Withdrawal
- Consumers bear return shipping costs.
- Refunds will be processed within 30 days, provided products are returned or proof of shipment is given.
Article 7 – Exclusion of Withdrawal
Withdrawal may be excluded for products or services that are:
- custom-made, personal, perishable, sealed audio/video or software products opened by the consumer, or hygienic items whose seal is broken;
- services related to accommodation, transportation, restaurants, leisure at specific dates, or lotteries where delivery has started with consumer consent.
Article 8 – Price
- Prices remain fixed for the offer duration, except for VAT or financial market fluctuations.
- Price increases within 3 months of contract formation only allowed if legally required.
- Deliveries outside the EU may incur import VAT or customs duties, paid by the consumer.
- All prices subject to printing or typographical errors; entrepreneur is not obligated to deliver at incorrect prices.

Article 10 – Conformity and Warranty
- Products/services comply with the contract, specifications, reasonable standards, and legal requirements.
- Any defects or incorrect deliveries must be reported within 30 days.
- Returns must be in original packaging and condition.
- Warranty does not affect statutory rights.
- Warranty void if consumer modifies or mishandles the product, or if defective due to government regulations.
Article 11 – Delivery and Execution
- Orders executed promptly, within 30 days unless otherwise agreed.
- Risk transfers to the consumer upon delivery.
- If delivery fails, the entrepreneur will attempt to provide a replacement; the right of withdrawal applies accordingly.
Article 12 – Continuous Transactions: Termination and Extension
- Consumers may terminate contracts with up to 1 month notice.
- Automatic extensions limited; trial subscriptions end automatically.
- Contracts exceeding one year can be terminated after 1 year with 1 month notice.
Article 13 – Payment
- Payments due within 7 days unless agreed otherwise.
- Consumers must report incorrect payment information immediately.
- In case of default, reasonable costs may be charged.
Article 14 – Complaints
- Complaints must be submitted within 7 days of noticing defects.
- Responses provided within 30 days; longer if necessary.
- Valid complaints result in free replacement or repair at entrepreneur’s discretion.
Article 15 – Disputes
- Dutch law applies, even if the consumer resides abroad.
Article 16 – CESOP
- From 2024, payment service providers may register data in the European CESOP system for VAT compliance
